Ballot Question:

Shall this Town adopt the following bylaws:

General Bylaw:

Non-Medical Marijuana Retailer.  There shall be no more than one (1) non-medical “marijuana retailer”, as defined in G.L. c. 94G, Section 1 as “an entity licensed to purchase and deliver marijuana and marijuana products from marijuana establishments and to deliver, sell or otherwise transfer marijuana and marijuana products to marijuana establishment and to consumers,” permitted to locate and operate with in the Town of Ayer.

Zoning Bylaw:

Non-Medical Marijuana Retailer.  There shall be no more than one (1) non-medical “marijuana retailer” as defined in G.L. c. 94G, Section 1 as “an entity licensed to purchase and deliver marijuana and marijuana products from marijuana establishments and to deliver, sell or otherwise transfer marijuana and marijuana products to marijuana establishment and to consumers,” permitted to locate and operate with in the Town of Ayer.

Summary Explanation:  In accordance with Massachusetts law, this ballot question seeks to determine if voters support a limitation on the number of non-medical marijuana commercial establishment that can conduct business within the Town, said limit being one (1) such establishment.  Both the General Bylaw and Zoning Bylaw were passed by Town Meeting on October 23, 2017.  Though both bylaws are identical, one is a General Bylaw which had to pass Town Meeting by a simple majority vote and the other is a Zoning Bylaw which had to pass Town Meeting by a 2/3 majority vote.   These bylaws must also be put to a ballot vote which will take place at the Special Election on Tuesday, November 28, 2017.  On the ballot, voters can vote either “Yes” or “No”.

A “Yes” vote will enact the two bylaws as passed by Town Meeting permitting the Town to set the number of non-medical “marijuana retailer” licenses to no more than one (1) in the Town of Ayer.
A “No” vote will defeat the two bylaws as passed by Town Meeting and they will not be implemented.

  • Last Day to Register to Vote:  Wednesday, November 8, 2017 at the Town Clerk’s Office (Open 8am to 8pm that day)

  • Last Day to Request and Absentee Ballot:  Monday, November 27, 2017 at 12pm NOON at the Town Clerk’s Office
