AYER WASTEWATER TREATMENT FACILITY – FY2019 IMPROVEMENTS
CONTRACT NO. 20DPW02

Sealed Bids for the General Contract for construction of Ayer Wastewater Treatment Facility – FY 2019 Improvements will be received by the Town of Ayer, Massachusetts at the office of the Department of Public Works, 25 Brook Street, Ayer, MA 01432 until 2:30 PM, December 4, 2019 and at that time and place bids will be publicly opened and read aloud.

Sealed Bids for the filed Sub-Contracts designated herein will be received at the office of the Department of Public Works, 25 Brook Street, Ayer, MA 01432 until 2:30 PM, November 13, 2019 and at that time and place bids will be publicly opened and read aloud.

The project includes modifications to the existing Process and Maintenance Building to create separate, isolated spaces within the building. This includes structural improvements and relocation of doors and windows, as well as new walls, and HVAC, plumbing, and electrical improvements. The project also includes demolition of an existing belt conveyor system, modifications to the existing grit classifier, and, site improvements.

The Contract Time shall be 220 Calendar Days commencing twenty days following the Effective Date of the Agreement. Substantial completion shall occur within 190 Calendar Days commencing twenty days following the Effective Date of Agreement and Final Completion shall be within 220 Calendar Days commencing twenty days following the Effective Date of Agreement.

In accordance with M.G.L. Chapter 149, Section 44D, General Bids will be valid only when accompanied by (1) a current certificate of eligibility issued by the Division of Capital Asset Management and Maintenance, showing that the General Bidder has the classification of Sewage and Water Treatment plants and a capacity to perform this work and (2) an update statement summarizing the General Bidder's record for the period between the latest Division of Capital Assets Management and Maintenance certification and the date the bid is submitted. Any General Bid submitted without the appropriate certificate and update statement is invalid and must be rejected. The estimated project cost is $1,200,000.00.

In accordance with M.G.L. Chapter 149, Section 44F, Filed Sub-Bids will be valid only when accompanied by a current certificate of eligibility issued by the Division of Capital Asset Management and Maintenance, showing that the Sub-Bidders have been certified in their particular Sub-bid category to participate on public construction projects and to perform the work required. The Sub-bid shall also be accompanied by a Sub-bidder Update Statement in a form as developed by DCAM. Any Sub-bid submitted without the appropriate certificate and update statement is invalid and must be rejected.

Contract Documents may be examined and/or obtained at the office of CDM Smith, 75 State Street, Suite 701, Boston, MA 02109 after 11 AM on Wednesday, October 16, 2019.

Contract Documents are available for examination at the Department of Public Works, 25 Brook Street, Ayer, MA 01432 after 2:00 PM, Wednesday, October 16, 2019 and online free of charge at www.ayer.ma.us

A deposit of $100.00 in cash, bank or certified check payable to the Town of Ayer, Massachusetts will be required for each set of the Contract Documents. Up to two complete sets of Contract Documents will be available to General Bidders and one complete set for each filed sub-bidder. A refund of the deposit will be made for such Documents returned in good condition within 30 days after the Bids are received. Additional sets may be purchased by bidders.

Bidders requesting Contract Documents by mail shall include an additional non-refundable check payable to CDM Smith in the amount of $25.00 per set to cover costs of handling and mailing.

Each General Bid and Sub-Bid shall be submitted in accordance with the Instructions to Bidders and shall be accompanied by Bid Securities in the amount of five percent of the bid. The following are the filed Sub-Bids required for this work:
1. Masonry Work
2. Painting
3. Plumbing
4. Heating, Ventilating, and Air Conditioning
5. Electrical

Bidders may not withdraw their Bids for a period of thirty days, excluding Saturdays, Sundays, and legal holidays after the actual date of the opening of the General Bids.

The Successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond with a surety company acceptable to the Owner.

Minimum Wage Rates as determined by the Commissioner of the Department of Workforce Development under the provision of the Massachusetts General Laws, Chapter 149, Section 26 to 27H, as amended, apply to this project. It is the responsibility of the Contractor, before bid opening, to request if necessary, any additional information on Minimum Wage Rates for those tradespeople who may be employed for the proposed work under this Contract.

The bidding and award of this Contract will be under the provisions of M.G.L. Chapter 149, Section 44A- 44J.

The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in its best interest.
